Суддя Тернопільського міськрайонного суду Тернопільської області Р.М.Грицак, розглянувши заяву заступника військового прокурора Тернопільського гарнізону в інтересах ОСОБА_1 про видачу судового наказу про стягнення з Тернопільського державного науково-технічного підприємства Промінь нарахованої, але не виплаченої заробітної плати в сумі 4843 грн. 55 коп.,-
ВСТАНОВИВ:
Заява підсудна Тернопільському міськрайонному суду та підлягає розгляду в порядку цивільного судочинства.
Матеріали заяви відповідають вимогам ст.ст. 96-99 ЦПК України, підстав для відмови у відкритті наказного провадження або для повернення заяви немає, а тому слід відкрити наказне провадження у справі.
Керуючись ч. 7 ст. 100 ЦПК України,-
УХВАЛИВ:
Відкрити наказне провадження у даний справі та видати судовий наказ у триденний строк з моменту постановлення даної ухвали.
